I, do hereby irrevocably indemnify and hold harmless:

SERDYNAMICS (PTY) LTD t/a HEAL

against all and any actions, suits, proceedings, claims, demands, costs and expenses of whatsoever nature and howsoever incurred which may be taken or made against the company or be incurred or become payable by the company arising out of any and all medical and or health and or beauty treatment/s conducted and or performed on me whatsoever, during the course of my stay at the Hospital, and during any treatment I have consented to be performed on me. I also am aware that Serdynamics (Pty) Ltd t/a Heal is an independent body and should only be seen as a middleman between the services/treatment offered by said SPAS’ and the Hospital and their patients themselves. Any SPA should be seen as an independent body delivering their own services and any treatment/s offered and agreements signed between the SPA and patients will be between themselves and Heal will not be a party to said agreement.

ASSUMPTION OF RISKS

I am aware that any treatment/s performed on me does involve risks, dangers and hazards and the possibility of personal injury, death, property damage and loss therefrom, and it all depends on which treatment/s I have chosen.

I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

  1. I freely and voluntarily agree to indemnify and hold the Company, and all of the officials, officers, agents and employees harmless from any liability whatsoever from any and all claims, demands, actions or causes of action for personal injury, including death, or property damage arising from or in any way connected to the treatment/s offered and conducted on me.
  2. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
  3. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the South Africa and no other jurisdiction; and
  4. Any litigation involving the parties to this Agreement shall be brought solely within the laws of the South Africa and shall be within the exclusive jurisdiction of Western Cape Regional or High Court.
  5. In entering into this Agreement I am not relying upon any oral or written representations or statements made by the Company or its agents with respect to the safety of the TREATMENT/S other than what is set forth in this Agreement.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY PROCEEDING TO CHECKOUT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
